These Pre-Order Terms and Conditions (“Terms”) govern your pre-order purchase of the Inara EMG Sensor Device (“Device” or “Product”) from Inara Technology Pty Ltd ABN 12 680 067 752⁠⁠​ (“Inara”, “we”, “us”, or “our”). By placing a pre-order, you agree to be legally bound by these Terms.


1. PRODUCT INFORMATION

Product Price: USD $219.00
Pre-Order Deposit: USD $89.00 (fully refundable before shipping)
Balance Due: USD $130.00 (payable before shipping)


The Inara EMG Sensor Device is a wireless electromyography (EMG) sensor designed for fitness training, performance optimization, and muscle activation tracking. The Device provides real-time muscle activation insights and data-driven feedback to help users optimize workouts, improve form, and track muscle engagement during exercise.

Important: This device is designed for fitness and wellness purposes only. It is not a medical device and is not intended to diagnose, treat, cure, monitor, or prevent any medical condition or disease. It is not a substitute for professional medical advice, diagnosis, or treatment.


2. PRE-ORDER PROCESS

2.1 Pre-Order Placement

  • By placing a pre-order, you are making an offer to purchase the Device.

  • We reserve the right to accept or decline your pre-order at our sole discretion.

  • Your pre-order is confirmed when you receive our email confirmation.


2.2 Payment

  • Pre-order deposit of USD $89.00 is required at the time of pre-order placement.

  • The remaining balance of USD $130.00 will be charged before shipping.

  • Accepted payment methods: credit card, PayPal, bank transfer.

  • All prices are in USD.

  • Australian customers may be subject to GST where applicable.


3. DELIVERY INFORMATION

3.1 Estimated Delivery

4. REFUND POLICY

4.1 Pre-Shipping Refunds

  • Your USD $89.00 deposit is fully refundable at any time before the Device ships.

  • Request a refund by emailing [support@inaratechnology.com].

  • Refunds processed within 7 business days to the original payment method.

  • You may cancel your pre-order for any reason without penalty before shipping.


4.2 Post-Shipping Returns

  • Once shipped, standard return policies apply.

  • You may return the Device within 30 days of receipt for a full refund if unsatisfied.

  • Returns must be in original condition with all packaging and accessories.

  • Return shipping costs are the customer’s responsibility unless the product is defective.


5. WARRANTIES AND CONSUMER GUARANTEES


5.1 Australian Consumer Law

  • Australian customers have consumer guarantees under the Australian Consumer Law (ACL) that cannot be excluded.

  • These include guarantees that goods are of acceptable quality, fit for purpose, and match their description.

  • If the Device has a major failure, you are entitled to a replacement or refund.

5.2 Limited Warranty

  • 12-month limited warranty from the date of delivery.

  • Covers defects in materials and workmanship under normal use.

  • Does not cover misuse, accidents, water damage, or normal wear and tear.

  • Warranty claims must include proof of purchase.


6. INTENDED USE AND LIMITATIONS


6.1 Fitness and Wellness Use

  • Designed for fitness training, workout optimization, and general wellness tracking.

  • Intended users: gym enthusiasts, personal trainers, athletes, and fitness professionals.

  • Provides muscle activation data to help improve exercise form and training effectiveness.


6.2 Not a Medical Device

  • Not a medical device and not evaluated by medical regulatory authorities.

  • Do not use for medical diagnosis, treatment, or health condition monitoring.

  • Consult healthcare professionals for any medical concerns.

  • Do not use Device data to make medical decisions.


6.3 Usage Limitations

  • Intended for use during exercise and training activities.

  • Not recommended for use in water or extreme environmental conditions.

  • Battery life and performance vary with usage.

  • Requires a compatible smartphone/tablet and the Inara mobile app for full functionality.


7. CHANGES TO ORDERS AND PRODUCT SPECIFICATIONS


7.1 Order Changes

  • You may modify your shipping address or contact information by emailing us before shipping.

  • Product quantity changes may be possible subject to availability.

  • We cannot guarantee modifications close to shipping dates.


7.2 Product Specifications

  • Specifications are current as of the pre-order date and reflect development targets.

  • Minor improvements or changes may be implemented during final development.

  • Any material change to core functionality will be communicated to pre-order customers.

  • You may cancel your pre-order if material changes are unacceptable.


8. COMMUNICATION AND UPDATES


8.1 Progress Updates

  • We will provide regular production updates via email.

  • Updates include manufacturing status and shipping timelines.

  • You can opt out of marketing emails while retaining order updates.


8.2 Delay Notifications

  • We will promptly notify you of any shipping delays.

  • For delays exceeding 60 days from the original estimate, you may cancel and receive a full refund.

  • Notices will be sent to the email provided with your pre-order.


9. PRIVACY AND DATA PROTECTION


9.1 Information Collection

  • We collect information necessary to process your order and provide updates (name, email, phone number, shipping address).

  • Payment information is processed securely and not stored on our servers.

9.2 Data Use and Protection

10. DEVELOPMENT AND MANUFACTURING RISKS


10.1 Hardware Development Risks

  • Manufacturing delays, supply chain issues, or component availability may affect delivery timelines.

  • While we work diligently to meet estimates, hardware development involves inherent uncertainty.


10.2 Performance Expectations

  • Final performance may vary slightly from initial specifications.

  • We are committed to delivering a high-quality product meeting the core functionality described.

  • Beta testing and QA may identify improvements implemented in the final product.


11. LIMITATION OF LIABILITY


To the fullest extent permitted by law:

  • Our liability is limited to replacement of the Device or refund of the purchase price.

  • We are not liable for indirect, incidental, special, or consequential damages.

  • Nothing in these Terms excludes or limits rights under the Australian Consumer Law where applicable.

  • Total liability shall not exceed the amount paid for the Device.


12. FORCE MAJEURE


We are not liable for delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or government actions;

  • Supply chain disruptions or component shortages;

  • Manufacturing facility issues or shipping delays;

  • Other unforeseeable events affecting production or delivery.


13. GOVERNING LAW


These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.

15. CHANGES TO TERMS

16. ENTIRE AGREEMENT


These Terms constitute the entire agreement between you and Inara regarding your pre-order and supersede all prior or contemporaneous communications.


17. SEVERABILITY


If any provision is found unenforceable or invalid, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
